Terms of Use

By opening a trail, joining a party or reading a report on shouldwebecofounders (the “Service”), you agree to these terms. If you don't agree, please don't use the Service.

1. Who can use it

You must be at least 16 years old (or the minimum digital-consent age where you live, if higher) to use the Service. If you use it on behalf of a company, you confirm you're allowed to accept these terms for that company.

2. What the Service is — and isn't

The Service is an entertainment and conversation tool that draws on published psychological research. It is not therapy, counselling, coaching, mediation, medical or mental-health advice, legal advice, or financial advice. It does not assess capability and must not be used to make hiring, firing, equity, investment, or other consequential decisions about a person.

Results are directional and self-reported. Nobody is scored, diagnosed or ranked, and you should treat the output as prompts for a conversation you have between yourselves.

3. Acceptable use

You agree not to:

  • use the Service to harass, coerce, shame or pressure another person;
  • submit content that is unlawful, hateful, threatening, or infringes someone's rights;
  • share another person's answers or report without their consent;
  • probe, scrape, reverse-engineer, overload, or attempt to bypass authentication, rate limits or access controls;
  • resell, sublicense, or present the Service as your own product.

We may suspend access or delete party data that appears to breach these rules.

4. Party codes and shared sessions

Party codes are short and deliberately easy to type, which means anyone holding a code can join that party and see what the party sees. Share codes only with the people you intend to play with. You are responsible for what's shared inside a party you open or join.

5. Your content

You keep ownership of the answers you submit. You grant us a limited licence to store, process and display that content to operate the Service (including producing your party's report and anonymous, aggregated usage statistics). We don't sell your content.

6. Our content

The Service's name, artwork, sprites, copy, sounds, question sets and code are owned by us or our licensors and are protected by intellectual-property law. Personal, non-commercial use of the Service is permitted; copying the question sets or artwork for your own product is not.

7. Availability and changes

The Service is provided on an as-is, as-available basis. We may change, suspend, or discontinue any part of it — including deleting inactive party data — at any time and without notice.

8. Disclaimers and limitation of liability

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy, and uninterrupted availability. We are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost business, or damage to relationships arising from your use of the Service. Where liability cannot be excluded, our total liability is limited to CAD $100 or the amount you paid us in the previous 12 months, whichever is greater. Nothing here limits liability that cannot lawfully be limited.

9. Indemnity

You agree to indemnify us against claims, losses and reasonable legal costs arising from your breach of these terms or your misuse of the Service.

10. Governing law

These terms are governed by the laws of British Columbia, Canada, and the courts located there have exclusive jurisdiction, without limiting mandatory consumer protections in your country of residence.

11. Updates and contact

We may update these terms; material changes will be reflected in the “last updated” date above and continued use means you accept the new version. Questions: hello@shouldwebecofounders.com.
